Does SB 931 Bank Deficiency Judgements on Short Sales in California?

In this video Trent Chapman of Short Sale Genius talks about SB 931, the new California Short Sale Law that goes into effect January 1st 2011.
The sad fact is this law doesn’t break any new and important ground for real estate agents or homeowners who are trying to close a short sale without future liability. As it is currently, any agent who knows how to negotiate short sales can get the release of liability on a first lien in California without SB 931. So what SB 931 does is make it so any agent can get the release of liability on any first position loan in California.
If the state senators wanted to really help out the homeowners of California, they would have included second liens in this law, but true to form the government has passed another law that fails to truly help homeowner avoid foreclosure in any meaningful way.
It appears that if any agent wants to truly protect their homeowner, then have to learn to negotiate for themselves.

The Professional Short Sale Negotiator – a New Face in the Real Estate Cast of Characters
An exhaustive (as in it pooped me out) study of Short Sale homes for sale in Orange County CA uncovered a rising trend in the number of Short Sale listings with the terms “Buyer to pay for Professional Short Sale Negotiator Fee of 1% of the sales price.” What in the world is going on here? This is just wrong on so many levels – let me outline just a few.

Wrongness Level 1. Isn’t the Short Sale Listing Agent a Professional Short Sale Negotiator?
That’s our job. When a Realtor agrees to help a distressed home owner sell their home for less than what they owe the bank, that Realtor has the fiduciary responsibility to negotiate on behalf of the seller, their client. That includes negotiating EVERYTHING on behalf of their client. By definition, they have signed a contract to be a Professional Short Sale Negotiator. How can they hand that fiduciary responsibility off to anyone else? Let alone ask a buyer to pay for it?
